Company court to look again at ASMI ‘mismanagement’
The company court will on Thursday look again at whether there should be an investigation into possible mismanagement at chip machinery maker ASMI.
The court decided last year to launch an investigation following complaints from major shareholders Hermes and Fursa. But this summer the high court tore up that ruling and sent it back to the company court to be re-examined.
Activist shareholders had taken ASMI to court arguing management was wrong to turn down a partial buyout offer from Applied Materials and that its CEO was not the right person to turn the company around.
ASMI has been embroiled in a heated discussion about separating into two parts since 2006.
