State may pass on administration costs, says court

The Dutch state is within its rights to charge administration costs on traffic fines, a court in Leeuwarden ruled on Friday.


The case was brought by law professor Bernd van der Meulen, who objected to pay &euro6 on the €99 fine he received for speeding. Van der Meulen said at the time he did not think the government should be allowed to pass on the administration cost.
Nor did he agree with the statement on the form saying it was not permissable to take traffic fine cases to court. The professor says you should always be allowed to complain.
Van der Meulen won his original case in an Amsterdam court, but the national collection agency took it to appeal.
He told the Telegraaf he is happy with the outcome because the Leeuwarden court said it is possible to take traffic fine cases to court.
‘I was not able to convince the judge, but someone else may be able to,’ he told the paper.
