Disciplinary board silent on struck-off notaries
The disciplinary board which looks into misconduct by notaries – a type of lawyer who deals with property and family law transactions – is refusing to name notaries who have been struck off or temporarily suspended, the Financieele Dagblad reports on Tuesday.
The paper says 15 notaries have been suspended and more than four struck off over the past three years.
However, the paper has seen a letter from the board to the land registry office in which the board states ex notaries themselves are responsible for stopping working. It is not the board’s job to ‘alert third parties to rulings affecting individuals’, the letter said.
Property transfers signed by a notary who has been suspended are not legal.
Legislation currently going through parliament would require the Dutch notary association KNB to keep a central register of ex members who have been struck off or suspended, a move the body welcomes.
