Dutch regulator fines Apple €5m in dispute over dating app payment rules

Dutch consumers authority ACM has fined tech giant Apple €5m for failing to meet its requirements on payment systems for dating apps, which limit makers to using Apple’s own product.

The ACM told Apple last August it had to adjust its conditions for inclusion in the Dutch App Store so that dating app providers can use payment systems other than Apple’s own.

That ruling, which is subject to penalty payments for non-compliance, was published on December 24 last year.

The ACM now says Apple has failed to ‘satisfy the requirements’ and is now liable for the first penalty payment.

The agency said Apple failed to adjust its conditions, so dating app providers are still unable to use other payment systems. ‘All dating app providers can currently do is ‘express their interest’, the ACM said.

In addition, ‘Apple has raised several barriers for dating-app providers to the use of third-party payment systems’ and this is also ‘at odds’ with ACM’s requirements, the watchdog said.

The ACM has now told Apple that it has not satisfied the requirements and will now have to pay a penalty of €5m, up to a maximum of €50m, for every week it fails to comply.
