Fundamentalist Christian primary school wrong to sack gay teacher
An fundamentalist Christian primary school in Oegstgeest may not sack a teacher because he is homosexual, a court in Leiden ruled on Wednesday.
The school began proceedings to sack the teacher after he left his wife and moved in with another man.
The court said that the simple fact the man has gone public with his homosexuality and lives with a man is no reason to suspend and then sack him.
It is illegal to differentiate on such grounds and questioning someone’s suitability to be a teacher because of their sexual preference breaks equal opportunity legislation, the court said.
Controversy
The issue of homosexuality in orthodox Christian schools is controversial.
The Netherlands has dozens of fundamentalist Christian schools which oppose homosexuality on Biblical principles. While funded by the government, they are run independently. Such schools may not discriminate but are free to determine their own ‘professional demands’ for teachers.
In practice, this means they are allowed to refuse gay teachers and pupils on the grounds that homosexuality conflicts with their religious principles.
