Court finds woman not guilty of killing her three babies

A 42-year-old woman from Geleen has been found not guilty of killing her three babies because there is not enough evidence that she actually killed them, a court in Maastricht ruled on Tuesday.


Anita C was arrested last year following the discovery of three dead babies at her home. She told the court last month she had no idea she was pregnant.
Three expert pathologists had given evidence about the cause of death. Two said the bodies were too badly decomposed to make a sound judgement. A Swiss pathologist told the court the third baby had been born alive and was either smothered or strangled.
‘While one could ask if a woman who has had two dead babies, could give birth to a third dead child’ the expert evidence shows ‘this is not impossible’, the court said in its ruling.
The public prosecution department, which urged the court to find C guilty of two cases of murder and one of manslaughter, is considering an appeal.
