The court said the ban, which is unlimited, is having a disproportional effect on the man’s freedom of movement.
Sytze van der Velde has three convictions for abusing young boys and is currently appealing against a five-year supervision order.
Appeal
Until that appeal process has been completed, Van der Velde cannot be put under the control of social workers, hence Eindhoven’s efforts to ban him.
Last year, a lower court also ruled against the ban, saying the threat of social unrest and revenge attacks against Van der Velde is not enough to support it, nor were fears that he may offend again.
The city council is to appeal against this latest ruling.
