Fyra train maker loses court battle to see reports, force new inquiry

The Italian maker of the Fyra high-speed train has lost its court battle to win access to the two technical reports over problems with the train and to force a new inquiry.

Judges in Utrecht on Wednesday ruled against the request by AnsaldoBreda. Their reasoning will be published later.

The Belgian and Dutch national railway companies said at the beginning of June they were pulling out of orders to buy more Fyra trains because of the technical problems.

Services between Amsterdam and Brussels have been suspended since the beginning of this year following a string of breakdowns.

AnsaldoBreda claims the trains were not properly maintained. It went to court calling for access to the technical reports and to force the Dutch and Belgian railways to honour their contracts. It also wanted an independent committee of experts to assess the technical problems.

Lawyers for AnsaldoBreda said they were disappointed at the ruling and may prepare an appeal, depending on the judges’ reasoning.
