Tax office wants access to mobile phone parking info, court says no

A company which enables people to pay for car parking by mobile phone does not have to hand over client details to the tax office, a court in Den Bosch ruled on Tuesday.

The tax office wanted SMS Parking to hand over details about where and when its 150,000 clients parked in 2012 so officials could check lease car drivers were not dodging tax.

However the court said it would not comply with the request because of the ‘unlimited nature of the demand for privacy-sensitive information’.

Advice

The tax office said it would appeal.

SMS Parking competitor Yellowbrick has given the tax office information about all its clients after taking legal advice.

However, now the courts have ruled otherwise, Yellowbrick says it wants the 2012 information returned and will not comply with any request for information about 2013.
