Nigerians win right to sue Shell in Holland

Environmental organisation Milieudefensie and four Nigerian farmers have been given the go ahead to sue Shell and Shell Nigeria in the Netherlands, news agency ANP reports.

Judges in the Hague said on Wednesday the case may go ahead despite Shell's claim that the Dutch courts do not have jurisdiction.

The villagers and Milieudefensie want to hold the Netherlands- based oil giant responsible for a leaking pipeline owned by its Nigerian subsidiary, which polluted farmland and woods in 2005.

They argue that Shell and its Nigerian arm are so closely linked that the court would be justified in taking the case. Shell says the case should be heard in Nigeria.

The case will start on February 10. Milieudefensie and the farmers are demanding Shell clean up the spillages and compensate farmers for loss of income.

This is a moral victory for all environmentally deprived Niger Deltans. I was at the court with my Nigerian colleagues on the 3rd December 2009 during the court hearing praying that the court should defy all the odds and accept to hear the case. We are fulfilled about today's rullings and will now go ahead and prove the justification of the lawsuit. Long Live the Niger Delta!!!

How dare they sue the country polluting their country! Do they NOT know that is OUR OIL under their land? We need that oil to run huge inefficient auto's and trucks? We need it to make plastic products that we do not need and wind up in our oceans?! Oh my lord, it just amazes me that because a company polluted your land that you can seek money to clean it up? How dare them... they should be ashamed for trying to correct a problem that foreign countries are doing to their land!! Now imagine it was YOUR property being polluted from a company in South America? Wouldn't you seek compensation?
