Ban on Iranian students is discriminatory, says supreme court

Dutch universities and hbo colleges can no longer refuse admittance to Iranian nationals who might come into contact with nuclear expertise, the supreme court ruled on Friday.

Educational institutes may not discriminate against students and academics on the grounds of nationality, the court said. Iranian students have been excluded from courses involving nuclear technology because of fears this would break UN sanctions against Iran.

However, UN sanctions can be kept without differentiating between Iranian and non-Iranian nationals, the court said in a statement. Although the Dutch state has said this is impossible, other countries have managed to achieve this and the Dutch argument is ‘unconvincing’, the court said.

Three dual-national Dutch Iranians – an undergraduate, a graduate student and a professor – went to court to have the ban ruled illegal. Lower courts had also found in their favour.

Iranian nationals have been banned from certain courses since 2008.

Twente University went even further for a time by closing its doors to all students from Iran, arguing it is impossible to keep them away from open lectures.

This is clearly a political decision, and politicians don't realise that the majority of the critical material concerning nuclear energy is already published and widely available!

Fine, just repeat the disaster caused when you had nuclear information stolen from the Netherlands by Pakistani scientists which started the nuclear race.
Surely the world will be a better place.

@Mel Surely the world would be better place if colonist(Uk,Dutch,French,Spanish,Portugese etc) never visited Asia,Africa and America.Because of greed,hunger,wealth these colonist destroyed,waged war,divide and rule,butchered.

Currently, Dutch IND rejects Iranians MVV request not only in nuclear field, but also in almost all eng. sections for all Iranian expats. I am pipeline engineer, I have received 4 offers in April 2012 and selected Dutch company offer and canceled the rest. I have resigned from my former to start the new one. After 6 months of being hold in anxiety my MVV request has been rejected. I lost all my opportunities, my job, and also now there is gap in my CV. I lost my everything in less than 6 months. Pipeline engineering is not a state of art technology. Why we should be punished for my government actions which I totally disagree and oppose them?

What remained from this is the mentality in Dutch companies that they cannot follow the costly and long interview procedure for Iranians. Because there is no evidence that IND would not do the same again!
IND should clarify the situation, if there are no more sanctions against individual Iranians in the Netherlands! Make it announce if you believe that in future, single person will not be affected by sanctions against a regime. Keep in mind that most of these young Iranians trying to live out of Iran could be part of the problematical system in Iran. But they are trying to stay out of it because they cannot trust their dictatorship regime!
