Five marijuana plants are okay, no matter how big they are

Tuesday 26 April 2011

Private individuals can grow up to five marijuana plants at home before facing criminal charges, no matter how big the yield is, the high court ruled on Tuesday.

However, growers will have to hand over the plants to police immediately if they get an official visit, the court said.

The ruling relates to separate home-grown cases dating back to 2006 and 2008. In one case, a man in Roermond was found to have five plants in his garden with a combined yield of 2,180 grammes. In the other, a couple were found with five plants yielding 6,712 grammes.

The public prosecution department had argued that the weight of the yield broke regulations allowing individuals to have up to five grammes of marijuana for their own use.

whewww I sure am glad the OM spent time and my tax money hassling these people for no legitimate reason!! 5 plants, get real. please go after REAL criminals with my tax money - there are plenty of them here in Holland, plenty. I am embarrassed for the OM when I read this nonsense. please stop child molesters, violent criminals, etc.

I disagree with the part saying ''However, growers will have to hand over the plants to police immediately if they get an official visit, the court said.''

I don't see the reason.. I don't have to turn in my car if I get stopped by a cop.

So if the cops can just come and take them then you really can't do it?As usual another law unclear and open for corruption.

What a comeback for the feudal system, You do the Marijana plantation, I do the buisness.
Courts in Netherlands are going insane.

This info has been around for quite some time on the ministry of justice site.
So long the plants are outside & no special equipment is used, one may grow up to 5 plants. Evidently it is not so much the plant but the money involved. The more weed consumed, the less alcohol is bought, go figure!

Anyone who can get more than 2kg of cannabis from 5 plants should be given an award!

"...a man in Roermond was found to have five plants in his garden with a combined yield of 2,180 grammes. In the other, a couple were found with five plants yielding 6,712 grammes."

Is that the weight of the entire plant(s), or the buds only, or the leaf and buds without stems and stalks; dried and prepared or fresh cut weight? It's a good yield, but highly unlikely that it's as fantastic as the Public Prosecutor was making out. A cured kilo from five plants - yeah, that's not bad; must have started them indoors during the winter and set them out in the spring, cut in October.
