Cartel fines not tax deductible: court
Friday 12 March 2010
Dutch companies which have been fined for anti-competitive practices may not deduct those fines against tax, a special court in Amsterdam which deals with taxation issues ruled on Thursday.
The Financieele Dagblad states that the rulings follow the recommendation of chief advocate Peter Wattel.
One of the two cases considered by the court concerns a €13,903 fine for cartel forming given to a gardening company. The other relates to a €2.5m fine passed on to its Dutch subsidiary by German building firm Knauf.
