Biological father to appeal against baby ruling

A Belgian couple who commissioned a surrogate mother to carry a baby for them are to appeal against a Dutch ruling awarding custody of the child to a Dutch family who bought her over the internet.

The girl’s biological father had sought a surrogate mother because his own wife was infertile. Baby Donna was born in 2005 using his sperm. However instead of handing over the baby as agreed, the surrogate mother said she had miscarried and sold the baby to a Dutch couple in Leusden.

Since then, baby Donna has been the subject of a string of court cases in Belgium and the Netherlands. Last year, a court in Arnhem gave the man the right to visit his biological child but turned down his demand that the child be returned to him.

The Belgian couple, who live in Antwerp, have always regarded themselves as the child's real parents. They call her Valentina.

This is obsurd! The child should be returned to the biological father and his wife. How is it even legal that the surrogate mother -- or any mother for that matter -- can even sell a baby? Dutch law is seriously flawed in this case. The Dutch courts should stop practicing protectionist law (of their nationals)and do the right thing.

Did I get this right. Someone sold a baby over the internet, and she is not in jail. A Dutch couple bought a baby over the internet, and still have the baby...and they are also not in jail. The baby has a father, and he is not allowed the baby. I hope this baby doesn't intend to sail around the world this year, because it may risk becoming a ward of the court!

After listening to many Dutch ridicule America, American, Presidents, policies... And continuing to see the Dutch court systems and laws on many levels, the accusations and charges are losing their legitimacy as the Dutch legal system at times is utter lunacy in what and who gets prosecuted (often the legal, the victims..) and who gets rewarded (the criminals or perps.

This absolutely insane and incedibly sad. The only real victim is the child. While the dutch legal system may be flawed, so is the american. Fathers may have equal rights to their children, but it is extremely difficult to get them enforced. Our system favors mothers. I hope that this man continues to fight for his daughter.
