Passive smoker wins damages from clinicTuesday 13 January 2009 A former doctors' secretary has been awarded damages for being subjected to second-hand cigarette smoke in 1999 and 2000, Trouw reports on Tuesday. The high court ruled that the Isala clinic in Zwolle was 50% responsible for the fact the woman developed an asthmatic condition, the paper says. The woman spent three months in an asthma clinic in Switzerland and was then declared unfit to work. The clinic, where the secretary worked for two doctors who were heavy smokers, argued that the woman's complaints were not caused by the smoking but were the natural progression of the disease. The amount of damages awarded against the clinic will be decided later, Trouw said. © DutchNews.nl
I have smoked for years and recently quit. I admit, the Damage to my lungs is my own fault. For non smokers though, Second hand smoke is just as bad as smoking, or worse. I never felt I should impose my second hand smoke on non smokers! I think the woman had a right to get some sort of compensation for the damages. Smoking should be banned in all public places, work etc, that affect other people who do not smoke, especially children. What complete and utter nonsense. I take it reading between the lines the woman had asthma in the first place,so if as the usual warnings say, PS could be a trigger to the disease why did she work there for a year.
More importantly has it taken 9 years to get to court, can one assume she has waited unlike the political climate gave her a better chance of winning.
I am a life long never smoker but if I had a disease, I would investigate every aspect of that disease in order that I could remain as healthy as humanly possible. This just seems to be about money.
