Cable company Ziggo faces court action after refusing to block film and music sharing website The Pirate Bay, anti-piracy lobby group Stichting Brein said on Saturday.
Ziggo has told Brein it has no intention of stopping The Pirate Bay and that the foundation has no legal basis to make such a request.
‘We are simply a channel,’ said a spokesman in the NRC. ‘We give people access to the internet and support an open internet.’
Brein’s director Tim Kuik said resorting to the courts is the foundation’s last resort in its campaign to have illegal sites shut down. It has targeted Ziggo as the biggest cable company in the country in the hope of establishing anti-piracy jurisprudence.
In the Netherlands it is not illegal to download music and film without paying for them but it is illegal to offer them to others free of charge.
Last October, a court in Amsterdam ruled The Pirate Bay was infringing authors’ rights and it should be closed off to Dutch users within three months.
