Ratification of European rescue fund was ‘unlawful’, says lawyer

Parliament’s decision to ratify the European rescue fund was ‘unlawful, negligent and hasty’, lawyer Bram Moszkowicz told the court in The Hague on Tuesday morning on behalf of his client, Geert Wilders.


Wilders, leader of the anti-immigration PVV party, says ratification of the rescue fund cannot be taken by a caretaker government and that the decision should wait until after the September 12 election.
However, last week parliament voted by a two-thirds majority to approve the establishment of the fund.
Unlawful
Wilders wants the judge to stop the legal procedure, Moszkowicz told the court. ‘My client is not putting political questions before you. But it is unlawful that a caretaker government has introduced this new law and that it has been voted on.’
In the Netherlands, once a government has fallen, it is not supposed to take any controversial decisions unless a majority of MPs agree.
Lawyers acting for the state said it is not possible for the judge to become involved in political decision-making nor to stop the procedure, the Volkskrant reports.
The judge will give his decision on Friday morning.
