Borssele nuclear plant to stay in state hands, rules high court

A stake in the Netherlands’ only nuclear power plant Borssele cannot be transfered to German power firm RWE the high court said on Friday.

Power firm Essent, now owned by RWE, had wanted to transfer its 50% stake in Borssele to the German firm as part of the takeover deal.
According to the statutes of the Borssele nuclear power station, the facility cannot be owned by a foreign listed company – a position now upheld again in court.
Power firm Delta, which is still in public hands, owns the other 50% of Borssele and opposed the transfer to RWE.
